1. Client(s) requests of Advanced Home Inspections, a visual inspection of the home at the above address.  The client, and/or client’s agent, hereby represents that all approvals necessary have been arranged for the Inspector’s entrance to the property and home.

2. Advanced Home Inspections agrees to perform a limited visual inspection at the above address and to provide Client with a written inspection report.  This report to give the apparent general condition of the home’s structure, components, and systems, and will identify all observable deficiencies that exist at the time of inspection.  The inspection will be performed in a manner consistent with the professional standars of the industry.  An example of such Standards may be seen at the web site www.ashi.com, or we will provide a copy at request.  This web address is provided for client’s informational purposes only.  Advanced Home Inspections makes no representation as to its affiliation with or membership in this or any other specific professional organization.

3. Client understands that the inspection and inspection report do not constitute a guarantee of the condition or fitness for any particular purpose, expressed or implied, nor is it an insurance policy, nor a substitute for the real estate transfer disclosures which may be required by law.

4. The inspection includes those systems and components identified in the inspection report.  Any area not exposed to view, concealed or inaccessible because of furnishings, carpets, or other concealment, and any items/areas excluded by inspection standards and/or agreement of the parties, is not included in this inspection.

5. The written report prepared by Advanced Home Inspections shall be considered final and exclusive findings for the structure.  Client understands and agrees to rely on the report findings and not on any oral discussions or comments that were made.  Client further understands and agrees that the Inspector reserves the right to modify the inspection report for a period of time not to exceed forty eight (48) hours after the report has been made available to the Client.

6. It is understood and agreed by and between the parties hereto that Advanced Home Inspections’, and its officers', agents', or employees', Limitation Of Liability for errors or omissions in the inspection report (except in the case of fraud or gross negligence) is limited and fixed to amount equal to the fee paid for the inspection and report.

7. Client understands and agrees that any claim arising out of the inspection and report for the above property, shall be reported to the Company in writing within six months after the Client discovers, or should have discovered, the claimed act or omission. Client further agrees to allow the Inspector reasonable access to re-inspect that portion of the property referred to in a claim.  Client understands and agrees that any failure to notify Advanced Home Inspections as stated above shall constitute a waiver of any and all such claims Client may have against the Inspector.

8. Claim of any kind, including those in tort or contract, against Advanced Home Inspections, its officers, agents, or employees, must be brought within two (2) years of the date of the inspection or will be deemed waived and forever barred.  This time is of the essence.    Client’s initials  ________________________________

9. If any provision of this Agreement is found invalid or unenforceable by any court or
arbitrator, the validity, legality, and enforceability of the remaining provisions shall  not in any way be affected or impaired.
